1. Introduction

Welcome to Island Gyal Hair Care (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website located at www.islandgyalhaircare.com (the “Site”), and any purchase of products through the Site. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase on this Site. By using the Site, you represent that you meet this requirement and that any information you provide is accurate and current.

3. Products and Descriptions

We strive to display product colors, ingredients, and descriptions as accurately as possible. However, we do not guarantee that your device's display of any color will be accurate, and product packaging or formulation may vary from what is shown on the Site. We reserve the right to limit quantities, discontinue products, or correct errors in pricing or descriptions at any time without prior notice.

4. Pricing and Payment
 

• All prices are listed in USD and are subject to change without notice.

• We reserve the right to refuse or cancel any order for any reason, including pricing errors, suspected fraud, or unavailability of stock.

• Payment is due in full at the time of purchase. We accept all major credit cards, PayPal, Pay Later Options etc.

• You represent that you are authorized to use the payment methods provided.
   

5. Order Acceptance

Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right to accept or decline your order for any reason after receipt of your order confirmation. 

UNCLAIMED OR UNRESOLVED ORDERS

Island Gyal Hair Care will make reasonable attempts to contact customers when additional information or payment is needed. If the customer does not respond or pay a required additional invoice within seven calendar days, the order may be canceled and refunded, less the disclosed 5% order-processing and cancellation fee.

6. Shipping, Delivery, Local Pickup

Estimated shipping times and costs are provided at checkout and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs (for international orders), weather, or other events beyond our control. Risk of loss and title for products purchased pass to you upon our delivery to the shipping carrier. Customers are responsible for providing a complete and accurate shipping address, including apartment, suite, building or unit numbers.
If a package is returned because the customer provided an incomplete or incorrect address, the customer will be responsible for the additional shipping cost to resend the order. The package will not be reshipped until the new shipping invoice has been paid.
Original shipping charges are nonrefundable when a package is returned because of an incomplete or incorrect customer-provided address.

LOCAL PICKUP

Local pickup is only available to customers who can collect their orders from our designated pickup location in the Wesley Chapel, Florida area. Selecting “Local Pickup” does not include shipping.

Customers who accidentally select local pickup but require shipping will be sent a separate shipping invoice. The shipping invoice must be paid within seven calendar days. Orders will not be shipped until the additional shipping charge is paid.

If payment is not received within seven calendar days after the invoice and reminder have been sent, the order may be canceled. A 5% order-processing and cancellation fee will be deducted from the refund to help cover nonrefundable payment-processing and administrative costs. 

CARRIER-DAMAGED PACKAGES

If a package is damaged while in the carrier’s possession and returned to Island Gyal Hair Care, the customer will not be charged an additional shipping fee. We will contact the customer and arrange for a replacement to be shipped after the damaged shipment is received and reviewed.

Customers should contact Island Gyal Hair Care promptly and provide photos of the shipping box, label, packaging and damaged products if a damaged package is delivered to them. Customers should keep all original packaging until the claim has been resolved.


7. Returns, Refunds, and Exchanges

Please refer to our Refund Policy for full details on eligibility, timeframes, and the process for returns and exchanges. For hygiene and safety reasons, certain products (such as opened or used hair care items) may not be eligible for return. 

8. Product Use and Disclaimer

Our products are intended for external cosmetic use only, in accordance with the instructions provided. We recommend performing a patch test before first use, especially if you have sensitive skin or scalp conditions, allergies, or are using other chemical treatments. Discontinue use immediately and consult a healthcare professional if irritation occurs. We are not liable for any adverse reaction resulting from misuse, an undisclosed allergy, or failure to follow product instructions.

9. Intellectual Property

All content on this Site, including text, graphics, logos, images, product names, and website design, is the property of Island Gyal Hair Care or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.

10. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use of your account.

11. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;

• Attempt to gain unauthorized access to our systems or another user's account;

• Upload or transmit viruses, malicious code, or unsolicited advertising;

• Copy, scrape, or resell any content or products from the Site without authorization;

• Interfere with the proper functioning of the Site.
   

12. Third-Party Links

Our Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, policies, or practices of any third-party sites.

13. Limitation of Liability

To the fullest extent permitted by law, Island Gyal Hair Care shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or your purchase shall not exceed the amount you paid for the product(s) giving rise to the claim.

You agree to indemnify and hold harmless Island Gyal Hair Care, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hillsborough, FL.

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the Site. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
